§1 Preliminary Provisions
The online store available at the internet address
is operated by Happy Adam Pytlak, conducting business under the name Happy Adam Pytlak, entered into the Central Register and Information on Economic Activity (CEIDG) kept by the minister responsible for economy, NIP: 8133648520, REGON: 367721910.https://adawoo.art These Terms and Conditions are addressed to both Consumers and Entrepreneurs using the Store and define the rules for using the Online Store as well as the rules and procedure for concluding Distance Sales Agreements with the Customer through the Store.
§2 Definitions
Consumer – a natural person concluding a contract with the Seller within the Store, the subject of which is not directly related to their business or professional activity.
Seller – a natural person conducting business under the name Happy Adam Pytlak, entered into the Central Register and Information on Economic Activity (CEIDG) kept by the minister responsible for economy, NIP: 8133648520, REGON: 367721910.
Customer – any entity making purchases through the Store.
Entrepreneur – a natural person, a legal person, or an organizational unit without legal personality to which a separate act grants legal capacity, performing business activity in its own name, who uses the Store.
Store – the online store operated by the Seller at the internet address
.https://adawoo.art Distance contract – a contract concluded with the Customer within an organized system for concluding distance contracts (within the Store), without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication up to and including the conclusion of the contract.
Terms and Conditions – these terms and conditions of the Store.
Order – the Customer's declaration of intent made via the Order Form and aimed directly at concluding a Product Sales Agreement with the Seller.
Account – a customer account in the Store, where the data provided by the Customer and information about Orders placed by them in the Store are collected.
Registration Form – a form available in the Store that allows for the creation of an Account.
Order Form – an interactive form available in the Store allowing for the placement of an Order, in particular by adding Products to the Cart and specifying the terms of the Sales Agreement, including the method of delivery and payment.
Cart – an element of the Store's software in which the Products selected by the Customer for purchase are visible, with the possibility of determining and modifying Order data, in particular the quantity of products.
Product – a movable item/service available in the Store which is the subject of the Sales Agreement between the Customer and the Seller.
Sales Agreement – a product sales agreement concluded or entered into between the Customer and the Seller through the Online Store. A Sales Agreement also includes – depending on the characteristics of the Product – a service agreement and a contract for specific work.

The Customer may communicate with the Seller using the addresses provided in this paragraph.
§4 Technical Requirements To use the Store, including browsing the Store's assortment and placing orders for Products, the following are necessary:
an end device with access to the Internet and a web browser like Firefox,
an active e-mail account,
cookies enabled,
FlashPlayer installed.
§5 General Information
To the fullest extent permitted by law, the Seller is not responsible for disruptions, including interruptions in the functioning of the Store caused by force majeure, unauthorized actions of third parties, or incompatibility of the Online Store with the Customer's technical infrastructure.
Browsing the Store's assortment does not require creating an Account. Placing orders for Products in the Store's assortment is possible either after creating an Account in accordance with the provisions of § 6 of the Terms and Conditions or by providing the necessary personal and address data enabling the execution of the Order without creating an Account.
Prices in the Store are given in EURO and are net prices; however, during the placement of the Order, gross prices (including VAT) are visible.
The final amount to be paid by the Customer consists of the price for the Product and the delivery cost (including fees for transport, delivery, and postal services), about which the Customer is informed on the Store's pages during the placement of the Order, including at the time of expressing the will to be bound by the Sales Agreement.
When the nature of the subject of the Agreement does not allow, reasonably assessing, for the prior calculation of the final price, information on the manner in which the price will be calculated, as well as on transport, delivery, and postal fees and other costs, will be provided in the Store in the Product description.
§6 Creating an Account in the Store
To create an Account in the Store, the Registration Form must be completed. It is necessary to provide the following data: first name, last name, e-mail address, phone number, country.
Creating an Account in the Store is free of charge.
Logging into the Account is done by providing the login and password established in the Registration Form.
The Customer may, at any time, without giving a reason and without incurring any fees, delete the Account by sending an appropriate request to the Seller via e-mail or in writing to the addresses provided in § 3.
§7 Rules for Placing an Order To place an Order, you should:
log in to the Store (optional);
select the Product that is the subject of the Order, and then click the "Add to cart" button (or equivalent);
log in or use the option to place an Order without registration;
if the option to place an Order without registration was chosen – fill in the Order Form by entering the recipient's details and the address for delivery, select the type of shipment, choose one of the available payment methods and, depending on the payment method, pay for the order within the specified period, subject to § 8 point 3.
click the "Order and pay" button (or equivalent), choose one of the available payment methods and, depending on the payment method, pay for the order within the specified period, subject to § 8 point 3.
§8 Offered Delivery and Payment Methods
The Customer may use the following methods of delivery or collection of the ordered Product depending on the item: courier shipment, shipping company delivery, personal collection available at the address: os. Przyjaźni 11D, 61-687 Poznań, Poland.
The Customer may use the following payment methods: bank transfer to the Seller's account, electronic payments, credit card payment.
Detailed information on delivery methods and acceptable payment methods can be found on the Store's pages during the placement of the Order.
§9 Execution of the Sales Agreement
The conclusion of the Sales Agreement between the Customer and the Seller takes place after the Customer has placed an Order using the Order Form in the Online Store in accordance with § 7 of the Terms and Conditions.
After placing the Order, the Seller immediately confirms its receipt and simultaneously accepts the Order for execution. Confirmation of receipt and acceptance for execution occurs by the Seller sending an appropriate e-mail to the Customer's e-mail address provided during the ordering process, containing at least the Seller's statement on receiving the Order and its acceptance for execution, and confirmation of the conclusion of the Sales Agreement. Upon receipt of the above e-mail by the Customer, the Sales Agreement is concluded.
If the Customer chooses payment by bank transfer, electronic payments, or credit card, the Customer is obliged to make the payment within 3 calendar days from the date of the Sales Agreement – otherwise, the order will be canceled.
If the Customer chose a delivery method other than personal collection, the Product will be sent by the Seller within the period indicated in its description (subject to paragraph 5 of this section), in the manner chosen by the Customer during the ordering process, with the maximum time for dispatch being 10 business days.
In the case of ordering Products with different delivery dates, the delivery date is the longest provided date.
The start of the delivery period to the Customer is calculated as follows: for electronic or card payments – from the date of crediting the Seller's bank account.
If the Customer chooses personal collection, the Product will be ready for collection within the period indicated in the Product description. The Customer will be additionally informed about the readiness of the Product for collection by the Seller via e-mail.
Delivery of the Product takes place worldwide.
Delivery of the Product to the Customer is payable unless the Sales Agreement provides otherwise. Delivery costs are indicated to the Customer on the Store's website in the "Delivery costs" tab and during the placement of the Order.
Personal collection of the Product by the Customer is free of charge.
§10 Right to Withdraw from the Agreement
A Consumer may withdraw from the Sales Agreement within 14 days without giving any reason.
The period specified in sec. 1 begins with the delivery of the Product to the Consumer or a person designated by them other than the carrier.
The Consumer may withdraw from the Agreement by submitting a statement of withdrawal to the Seller. Sending the statement before the deadline is sufficient to meet it.
The statement can be sent via traditional mail to the Seller's address or via e-mail. A model form is attached as Annex 1.
In the event of an electronic statement, the Seller will immediately send a confirmation of receipt.
Effects of withdrawal: a. In the case of withdrawal from a distance contract, the contract is considered null and void. b. The Seller shall return all payments made by the Consumer, including delivery costs (except for additional costs of a non-standard delivery method), no later than 14 days from receiving the statement. c. Refunds are made using the same payment methods as the original transaction unless the Consumer agrees otherwise. d. If the Customer used the "Buy 3 sets and get 10% discount" promotion and decides to return part of the order resulting in the promotion requirements not being met, the discount is canceled. e. The Seller may withhold the refund until the Product is received back or proof of return is provided. f. The Consumer must return the Product no later than 14 days from the withdrawal. g. The Consumer bears the direct costs of returning the Product.
The right of withdrawal does not apply to contracts: a. where the subject is a non-prefabricated item, manufactured to the Consumer's specification or intended to satisfy their individualized needs, b. where the item is delivered in a sealed package which cannot be returned after opening for health or hygiene reasons, c. where the item is subject to rapid decay or has a short shelf life, d. for the provision of services if the Seller has fully performed the service with the express consent of the Consumer.
§11 Complaints and Warranty
The Sales Agreement covers new Products.
The Seller is obliged to deliver an item free of defects.
In the event of a defect, the Customer has the right to a complaint based on the warranty (rękojmia) provisions in the Civil Code. If the Customer is an Entrepreneur, the parties exclude liability under the warranty.
Complaints should be submitted in writing or electronically.
The Seller declares a 30-day period for considering the complaint.
Products returned under the complaint procedure should be sent to the address provided in § 3.
§12 Out-of-court Dispute Resolution Detailed information regarding the possibility for the Consumer to use out-of-court methods of dealing with complaints and pursuing claims is available at the offices and on the websites of consumer ombudsmen and the Office of Competition and Consumer Protection (UOKIJK).
§13 Personal Data in the Online Store
The administrator of personal data is the Seller.
Data is collected to perform the Sales Agreement, fulfill legal obligations (e.g., invoices), and, if agreed, for marketing purposes.
Data may be shared with carriers and payment operators.
The Customer has the right to access and correct their data.
§14 Final Provisions
Contracts are concluded in Polish.
The Seller reserves the right to change the Terms and Conditions for important reasons (e.g., law changes, payment/delivery method changes). Customers will be informed at least 7 days in advance.
In matters not regulated, Polish law applies (Civil Code, Consumer Rights Act, etc.).
